ARTICLE 1 – PERSONAL INFORMATION COLLECTED

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.


ARTICLE 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.


How can I withdraw my consent?

ARTICLE 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.


ARTICLE 4 – SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify's data storage, databases, and the general Shopify application. Your data is stored on a secure server behind a firewall.


Payment:

If you choose a direct payment gateway to complete your purchase, Shopify stores your credit card information. This information is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction information is stored only as long as is necessary to complete your order. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

ARTICLE 5 – PRODUCTS OR SERVICES (if applicable)

Our products or services are only available online at laboxchanvre.com. These products or services may be available in limited quantities and are only subject to returns or exchanges in accordance with our Return Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
The Chanvré box reminds you that The use of CBD flowers is strictly reserved for use in the form of herbal teas, as French law strictly prohibits the consumption of flowers in the form of rolled cigarettes.
The Chanvré box and its representative are therefore in no way responsible for any other use of the products sold.
We also remind you that it is strictly forbidden to drive after consuming products containing THC, even if their THC level is less than 0.2%.
The Chanvré box also reminds you that all of the products it offers are in no way remedies and/or treatments for the pathologies listed on our website. 
The products offered by La box Chanvé are so-called “well-being” products, intended to help you relax and unwind.

ARTICLE 6: PRODUCTS


The prices of our products on the site are indicated in euros, all charges included and delivery included in France (excluding delivery costs for Belgium, Luxembourg and French overseas territories). They are applicable upon validation of the order by the consumer (subject to availability). Prices are subject to French VAT and any change in the legal rate of this VAT will be implicitly reflected in the prices of the products presented on the La box Chanvré site on the date stipulated by the implementing decree referring to it.

2°Availability

The offers presented by La box Chanvré are only valid while stocks last. In the event of unavailability and in accordance with Article L 121-20-3 of the Consumer Code, you will be informed by email or telephone of the items that are out of stock. The buyer will then have 72 working hours (excluding Saturdays, Sundays, public holidays or non-working days) from the date of signing the order form to request cancellation, reimbursement of the amounts collected or exchange of his order within the limit of an equivalent total price by contacting us by email. After this period and if no request is made from you, your order will be sent to you with the available items and only these items will be invoiced to you. Unavailable items will be credited via bank transfer.

3°Conformity of product offers

The products offered comply with current French legislation and the standards applicable in France. In accordance with Article L 111-1 of the Consumer Code, the consumer has the opportunity to know the essential characteristics of the products he wishes to purchase before placing a final order.
ARTICLE 7 - RIGHT OF WITHDRAWAL
In accordance with Articles L221-18 et seq. of the French Consumer Code, in the context of distance selling, the Customer has a withdrawal period of fourteen (14) working days from receipt of the box to exercise their right of withdrawal. Notification of withdrawal must be made via the "Contact" page on our website laboxchanvre.com or by email contact@laboxchanvre.com
Pursuant to Article L221-22 of the Consumer Code, the burden of proof of exercising the right of withdrawal rests with the Customer.
Goods must be returned in their original packaging and packaging. Return shipping costs will be borne by the Customer.
Any incomplete, damaged, damaged product and/or damaged packaging will not be returned, exchanged or refunded.
In fact, the subscription covers a complete box per month, so the return of the complete box is essential.
Where applicable, La box Chanvré will reimburse the Customer who has notified the exercise of their right of withdrawal within the time limit within a maximum of fourteen (14) days from receipt of the notification of withdrawal.
The Customer's account will be re-credited with the amount debited using the same payment method used to place the order.
ARTICLE 8: DELIVERY
La box chanvré delivers its products to mainland France, Belgium, Luxembourg and the French overseas departments and territories. The products will be delivered to the address indicated by the consumer on the order form. Delivery costs are fixed and vary depending on the delivery area. The consumer has a legal and contractual obligation to check the physical condition and contents of the package(s) upon delivery in the presence of the delivery person.

1° Anomaly
Any anomaly concerning the delivery must be indicated on the carrier's delivery slip in the form of detailed, dated, explicit "handwritten reservations" accompanied by the signature of the consumer or a person authorized to receive the delivery. The consumer must also report this anomaly by sending the carrier a registered letter with acknowledgment of receipt within 3 working days of the delivery date, setting out the said complaints.
Then, he must simultaneously send a copy of this registered letter by regular mail to: La Chanvré 35 RUE DES CHANTIERS 78000 VERSAILLES. Any complaint concerning delivery arriving late will be definitively rejected without the possibility of recourse for the consumer and only the damages and anomalies mentioned in the said reservations expressed by the consumer will be taken into account in the resolution of the dispute by the carrier.

b. Delay in delivery or non-execution of the order
La box Chanvré cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, disruption, total or partial strike, in particular of postal services and means of transport and/or communication, flood or fire. La box Chanvré incurs no liability for any indirect damage due to operating losses, loss of profit, loss of opportunity, damage or costs that may arise from the purchase of the products.

ARTICLE 9 – SERVICES PROVIDED BY THIRD PARTIES


In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies carefully so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

ARTICLE 10 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
COOKIES

Here is a list of cookies that we use. We have listed them here so that you can choose whether you want to allow them or not.

_session_id, unique session identifier, allows Shopify to store information about your session (referrer, landing page, etc.).

_shopify_visit, no data held, persists for 30 minutes from the last visit. Used by our website provider's internal stats tracker to record the number of visits.

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day. Calculates the number of visits to a store by a unique customer.

cart, unique identifier, persistent for 2 weeks, stores information about your shopping cart.

_secure_session_id, unique session identifier

storefront_digest, unique identifier, undefined If the store has a password, this is used to determine if the current visitor has access.


ARTICLE 11 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
